“CARIGNAN” and “MARSANNE” 34530 AUMES .
1. Ann Brown (the owner) offers the property known as “CARIGNAN” or “MARSANNE” for holiday rental subject to confirmation to the signatory after receipt of the booking form.
2.To reserve the property, the client should complete and sign the booking form and return it together with the non-refundable deposit of 25% of the total due. Following receipt of this completed booking form the owners will confirm the booking by e-mail. This is the formal acceptance of the booking. Please make cheques payable to: Ann Brown and send to:

3.The balance of the rent, together with the security deposit (see clause 4) is payable not less than eight weeks prior to the start of the rental period. If payment is not received by the due date, the owners reserve the right to give notice in writing that the reservation is cancelled. The client will remain liable to pay the balance of the rent unless the owners are able to re-let the property. In this event then clause 5 of these booking conditions will apply. Reservations made within eight weeks of the rental period require full payment at time of booking.
4. A security deposit of £250 for a period of up to three weeks (and pro-rata thereafter ) rental is required at the time the full balance is due, in case of, for example, damage to the property or its contents. However, the sum reserved by this clause shall not limit the clients liability to the owners. The owners will account to the client for the security deposit and the monies held until the end of the rental period. A full refund of this security deposit will be made within two weeks of the end of the rental period, and after confirmation that the house and contents are in order and the keys have been returned. It is the responsibility of the client to ensure that no breakages occur and that the house is in good order on the arrival day. (See also section 10)
5. Subject to clauses 2 & 3 above, in the event of a cancellation a refund of the balance payment will be made if the owners are able to re-let the property and any expenses and or losses incurred in doing so will be deducted from the refundable amount. The client is strongly advised to take full comprehensive travel insurance for the party, including cancellation cover, full cover for the party’s personal belongings, public liability, burglary, injury, illness etc. as these are not covered by the owner’s insurance.
6. The rental period shall commence at 4pm.on the first day and finish at 10am. on the day of departure. The owners are not in a position to offer the accommodation before the time stated and the client shall not be entitled to remain in occupation beyond the time stated.
7. The maximum number of persons to reside in the property must not exceed eight.
8. The client agrees to be a considerate tenant and to take good care of the property and its contents and to leave it in a clean and tidy condition at the end of the rental period. Although some cleaning is included in our prices, the owners reserve the right to make a deduction from the security deposit to cover extra cleaning costs if the client leaves the property in an unacceptable condition where cleaning exceeds one hour. The client is offered the possibility to pay for cleaning at a cost of 20€ / hour.
The client also agrees not to act in any way which could cause disturbance to those residing in neighbouring properties. The pool is strictly for use of the party on the booking form only and children should be supervised at all times as the owners cannot be held responsible for any mishaps whatsoever. The pool shall at all times be controlled by a responsible adult capable of swimming,
9. Safety should be uppermost when using the BBQ. There are restrictions during the summer months due to the possibility of fires, and it should not be used on very windy days.
10. The client should report to the owners agent without delay, any defect to the property or breakdown in any equipment or appliances in the property, should it arise during the stay. Unless such a report is made on the day of arrival, all damage will be deemed to have occurred during the stay. Arrangements for repair/maintenance will be made as soon as possible. This is particularly important with pool safety equipment. The pool shall be controlled by a responsible adult capable of swimming,at all times.
11. The owners shall not be liable to the client for:
Any temporary defect in the supply of public services to the property, nor in respect of any equipment, plant, machinery or appliance in the property, garden or swimming pool.
Any loss, damage or injury, which is the result of adverse weather conditions, riot, war, strikes or other matters beyond the control of the owners. Any loss, damage or inconvenience caused to or suffered by the client if the property shall be destroyed, or substantially damaged before the start of the rental period. In any such event, the owners shall within seven days of notification to the client, refund to the client all sums previously paid in respect of the rental period.
12. Under no circumstances shall the owner's liability exceed the amount paid to the owner for the rental.
The owners would ask the clients to respect local laws and customs. Sorry but no pets allowed in the property and the owners, in respect for all clients, would ask those who smoke, to do so outside or on the terrace. During the summer months, water is a valuable commodity, so please keep wastage to a minimum.
The pool is for sole use of the residents, and for safety, only the plastic glasses supplied for the purpose and plastic drink bottles should be taken near the pool area. Any broken glass in the pool could result in injury and/or major cleaning. The pool is available from the beginning of April to the end of September. In other months it will not be available for swimming unless specifically agreed with the owners.
Electricity is included in the rental costs for normal consumption up to 250 units per week. Units used in excess of this are charged at 10p. per unit. The meter is read on arrival and on departure. A unit is one thousand watts for one hour.
Please switch off air conditioning when not in the house, it is very efficient and will cool the room in a few minutes.
When the air-conditioning is working, please close the doors to that room.
Bottled gas for the kitchen hob is included in the rental costs.
Bed linen is provided for eight persons during Peak and High season.
During rental periods other than Peak and High season, bed linen and towels are provided for the number of guests in the house.
Any proceedings arising out of or in connection with this contract may be brought in any court of competent jurisdiction in France.
Whilst wishing to help repatriate articles to their owners, it can be disproportionately time consuming and expensive. In addition to the postage there will be a £20 service charge to cover these expenses.
